BABYSITTER REFERRAL SERVICES AGREEMENT & RELEASE OF LIABILITY

   Sitter Solutions, LLC WILL NOT PROVIDE BABYSITTER REFERRAL SERVICES WITHOUT FIRST RECEIVING THIS SIGNED AGREEMENT AND RELEASE OF LIABILITY. PLEASE NOTE THAT BABYSITTER SERVICES ARE NOT GUARANTEED.

   Sitter Solutions, LLC WILL NOT PROVIDE BABYSITTER REFERRAL SERVICES IF THIS DOCUMENT IS ALTERED IN ANY MANNER.

   PERSONS LISTED ON THE Sitter Solutions, LLC BABYSITTER REFERRAL SERVICES LIST ARE NOT EMPLOYEES OF Sitter Solutions, LLC.  

   Sitter Solutions, LLC ASSUMES NO RESPONSIBILITY OR LIABILITY ASSOCIATED WITH HIRING A BABYSITTER NAMED ON THEIR BABYSITTER REFERRAL SERVICES LIST, REGARDLESS OF WHO CONTACTED AND SECURED THE SERVICES OF THE BABYSITTER.

This Agreement certifies that I have requested that Sitter Solutions, LLC, or any of its entities thereto, (hereinafter referred to as SITTER SOLUTIONS) provide me with Babysitter Referral Services. Said Services consist of providing me with the names of potential babysitters and, upon my request, contacting a babysitter that I may hire to supervise a child in my care or custody. I understand that if I refuse to sign and accept this Babysitter Agreement & Release of Liability, or if I alter this document in any manner, SITTER SOLUTIONS will not allow me to acquire the services of a babysitter by way of SITTER SOLUTIONS Babysitter Referral Services.

By my signature below, I affirm and attest that said Babysitters are not employees of SITTER SOLUTIONS; that SITTER SOLUTIONS does not recommend any Babysitter; and that SITTER SOLUTIONS assumes no responsibility or liability associated with hiring a Babysitter named on the SITTER SOLUTIONS Babysitter Referral Services List, regardless of who contacted and secured the services of the Babysitter.

By my signature below, I affirm and attest that it is not possible to predict a person’s reaction to every situation and/or condition with which they are confronted. I acknowledge that it is therefore impossible to guarantee that the babysitter I hire by way of SITTER SOLUTIONS Babysitter Referral Services will act safely in all situations. I hereby affirm that I am duly aware of the inherent risks that may be associated with utilizing the services of a babysitter and that I voluntarily elect to utilize SITTER SOLUTIONS Babysitter Referral Services.

By my signature below, I hereby authorize SITTER SOLUTIONS to contact any babysitter named on the SITTER SOLUTIONS Babysitter Referral Services List in an effort to ascertain their availability and/or desire to provide said service, and to reserve in my name and on my behalf, on the date(s) and at the time(s) I have indicated, the services of any available babysitter named on said SITTER SOLUTIONS Babysitter Referral Services List.

Therefore, in consideration of SITTER SOLUTIONS providing me with said SITTER SOLUTIONS Babysitter Referral Services, I hereby release SITTER SOLUTIONS, its owners, agents, assigns, officers, directors, servants, employees, partner agencies, and affiliates, of and from any and all liability, claims, demands, actions and causes of action, whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, any property of mine, my minor children, or any child in my custody, as a result of my use or employment of any person referred by way of SITTER SOLUTIONS Babysitter Referral Services.

I, the undersigned, acknowledge that I have carefully read this agreement and release of liability and understand its contents. I understand that my signature below expressly waives any rights I have to bring a claim against or sue SITTER SOLUTIONS for injuries or damages. I further understand that this a contract that limits my legal rights and that it is binding upon me, my heirs and legal representatives.

Terms of Use and Privacy Policy

By reading the below information and paying for the reservation fee you are agreeing to the following general terms made by Sitter Solutions, LLC:

All payments are required when service is provided.  A fee of $50.00 will be charged for late payment.

All reservation payments are to be made directly to Sitter Solutions, LLC.

All transactions including reservations and communication must be handled directly by Sitter Solutions, LLC.  Please DO NOT schedule any additional services with your sitter.  This act would be a breach of contract and a $500 fee will be assessed if you should solicit a sitter without giving notice to Sitter Solutions, LLC.  

All emergency contacts must be listed on the application in the event the sitter cannot reach a parent in an emergency.  

Application and forms must be signed before service can be rendered.

A confidential review of the service will be required for you to complete after the service is completed.  This review will only be seen by Directors of Sitter Solutions in order to maintain a high quality of service.  

If services are cancelled for any reason by Sitter Solutions, LLC no fee will be assessed.

If services are cancelled by you, the client, without 4 hours notice, and for any reason, all services will be charged the 3 hour minimum with an additional cancellation fee ($10).

I herby release Sitter Solutions, LLC from any and all liability or damages related to my child’s participation in Sitter Solutions Service.

I am the legal parent/Guardian of the child or children and have the authority to enter this child in Sitter Solutions Service.

I give my permission for any necessary immediate first aid treatment deemed necessary by the sitter.

I give permission to the sitter to transport my child by car for emergency situations.

Terms of Use

No Liability

Users agree not to hold Sitter Solutions, LLC, agents, and employees, officers, directors, corporate partners, referring agencies, or participants liable for any advice or services delivered which originated through the Site or otherwise were provided. Users release Sitter Solutions, LLC and its agents, officers, directors, corporate partners, and employees from claims, demands, and damages (actual or consequential) of every kind and nature, known and unknown, disclosed and undisclosed, arising out of or in any way connected with any such disputes.

Indemnification

By agreeing to the terms of this Agreement, Users agree to indemnify, defend, and hold harmless, its directors, officers, employees, agents, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates (collectively referred to herein as " Sitter Solutions, LLC ") from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred by Sitter Solutions, LLC and Affiliates in connection with any claim by a third party (including an intellectual property claim) arising out of (i) materials and content Users submit, post or transmit through the Site, or (ii) use of the Site in violation of these Terms of Use or in violation of any applicable law. Users further agree that they will cooperate as reasonably required in the defense of such claims. Sitter Solutions, LLC and affiliates reserve the right, at their own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Users, and Users shall not, in any event, settle any claim or matter without the written consent of Sitter Solutions, LLC Users further agree to hold harmless Sitter Solutions, LLC and Affiliates, as well as, if applicable, anyone who pays for the Service on the User's behalf, from any claim arising from a third party's use of information or materials of any kind that they transmit through or post on the Site.

Term of Agreement

This Agreement will become effective immediately upon any use by any User of the Site and shall remain effective unless terminated by Sitter Solutions, LLC as provided hereunder. Sitter Solutions, LLC may terminate this Agreement by providing the affected User or Users with written or email notice of such termination, which shall be effective immediately upon delivery of such notice to the User or Users – this notice may be included in or accompany notices of “adverse action” given when termination is based on information in a consumer report (such as a background check). Furthermore, Sitter Solutions, LLC may terminate this Agreement immediately for any breach of this Agreement or any applicable policy of Sitter Solutions, LLC as posted on the Site from time to time. If Sitter Solutions, LLC terminates a User's membership in the Service because the User has breached this Agreement, the User will not be entitled to any refund of unused subscription fees. All decisions regarding the termination of accounts shall be made in the sole discretion of Sitter Solutions, LLC. Except as required by law, Sitter Solutions, LLC is not required to provide any User with notice prior to terminating the User's membership and/or subscription. Except as required by law, Sitter Solutions, LLC is not required to disclose, and may be prohibited from disclosing, a reason for the termination of the User's account. Even after the User's membership or subscription is terminated, this Agreement will remain enforceable against such terminated User. All terms that by their nature may survive termination of this Agreement shall be deemed to survive such termination.

Modifications to the Site

Sitter Solutions, LLC reserves the right in its sole discretion to review, improve, modify or discontinue, temporarily or permanently, the Site or any content or information on the Site with or without notice to the User. Users have the same rights with regard to their self-generated content on the Site. Users agree that Sitter Solutions, LLC shall not be liable to User or any third party for any modification or discontinuance of the Site.

Limitation of Liability

Under no circumstances will Sitter Solutions, LLC or its Affiliates be liable to Users for any indirect, incidental, consequential, special or exemplary damages arising from any provision of this Agreement or any violation of any provision of this Agreement. Furthermore, the aggregate liability of Sitter Solutions, LLC or its Affiliates arising with respect to this Agreement and the Site will not exceed the total amounts paid by any User in the previous twelve (12) months under this Agreement. Any notice or other communication to be given hereunder will be in writing and given by facsimile, postpaid registered or certified mail return receipt requested, or electronic mail.

Disclaimer of Warranties

USER EXPRESSLY AGREES THAT THE USE OF THIS SITE IS AT THE USER'S SOLE RISK. NEITHER Sitter Solutions, LLC NOR ITS AFFILIATES OR LICENSORS WARRANT THAT ACCESS TO THE SITE WILL BE UNINTERRUPTED OR THAT THE SITE WILL BE ERROR-FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE OR MERCHANDISE PROVIDED THROUGH THE SITE. Sitter Solutions, LLC IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE WEBSITE OR SERVICE. THE SITE IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER THE COMPANY NOR ITS LICENSORS WARRANT OR GUARANTEE THE TIMELINESS, ACCURACY OR COMPLETENESS OF THE INFORMATION APPEARING ON THE SITE. ADDITIONALLY, THERE ARE NO WARRANTIES AS TO RESULTS OF ANY USER'S USE OF THE INFORMATION AVAILABLE ON OR VIA THE SITE. Sitter Solutions, LLC . AND AFFILIATES DO NOT WARRANT THAT THE SITE IS FREE FROM VIRUSES, WORMS, TROJAN HORSES, OR OTHER HARMFUL COMPONENTS. THE COMPANY AND ITS AFFILIATES TAKE REASONABLE MEASURES TO ENSURE THAT THE INFORMATION PROVIDED BY USERS IS DISCLOSED ONLY TO THOSE PERSONS SPECIFIED BY USERS. Sitter Solutions, LLC CANNOT AND DOES NOT, HOWEVER, GUARANTEE THAT THE PERSONAL INFORMATION ENTERED BY USERS WILL NOT BE MISAPPROPRIATED, INTERCEPTED, DELETED, DESTROYED OR USED BY OTHERS. USERS AGREE NOT TO HOLD Sitter Solutions, LLC LIABLE FOR ANY LOSS OR DAMAGE OF ANY SORT INCURRED AS A RESULT OF ANY SUCH MISAPPROPRIATION, INTERCEPTION, DELETION, DESTRUCTION OR USE OF INFORMATION PROVIDED BY USERS THROUGH THE SITE. THE COMPANY AND AFFILIATES SHALL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING FROM THE USE OR INABILITY TO USE THE SITE.

Privacy Policy

Sitter Solutions, LLC uses the information submitted by its users for the sole purpose of reservations and staffing a sitter.  By no means do we communicate your personal information with outside companies.  All your information is held in strictest confidence.  You information will never be shared, sold or divulged to any third parties.

Choice/Opt-Out

Our site provides users the opportunity to opt-out of receiving communications from us and our partners at the point where we request information about the visitor. This site gives users the option to remove some of their information from our database, to not receive future communications or to no longer receive our service. Information critical to a transaction or upon which Sitter Solutions, LLC or a service provider has relied (e.g., information provided to make a payment or obtain a consumer report) may not be removed or altered.
